Bentley Woods Estates is a beautiful family community in the Town of Flower Mound, Texas. Groundbreaking began in 1992 and the fully developed community now contains 125 homes nestled along the northern bank of Stone Creek and Wilkerson Park.


Bentley Woods Estates Homeowners Association (HOA), Inc.

What is an association?
It is a not-for-profit corporation in which the owners of lots are members. The Association is "governed" by a Board of Directors and was formed to handle the maintenance of the common areas and to enforce the deed restrictions.

How does the association work?
The Board of Directors of Bentley Woods Estates Homeowners Association Inc. has the power, duty and responsibility of maintaining and administering the Common Properties, collecting and disbursing the assessments and charges mentioned in the HOA By-laws and covenants. They also have the responsibility and right to administer and enforce the Declaration of Covenants, Conditions and Restrictions (CC&R's) for Bentley Woods Estates.

Common Area Maintenance
The Association maintains the common property areas for your benefit at Bentley Woods Estates. This includes negotiating the performance to assure conformity in service and effect.

Use Restrictions
There are a number of restrictions regarding what you may or may not do with your property, all of which are intended to enhance the integrity of your neighborhood and assist in maintaining your property value. A complete listing of the use restrictions is included in the Declaration of Covenants, Conditions and Restrictions (CC&R's) for Bentley Woods Estates, which you received with your resale certificate. Please read the CC&R's carefully as living in an Association has many benefits as well as responsibilities. If you have any questions about a project you are planning, contact an HOA Board member who can put you in touch with the Architectural Control Committee.

Architectural Control
The Board of Directors appoints an Architectural Control Committee to protect aesthetic character of the community. Residents planning to make any exterior alterations to their homes are required to make formal application to this Committee for approval prior to making any changes. The applications are acted upon by the Committee to ensure compliance with the deed restrictions and design standards of Bentley Woods Estates Homeowners Association, Inc. The Assessment
Since the Association is in effect a quasi-governmental organization, there are costs associated with its operation. For example, there are expenses for the landscape maintenance, accounting and management. In addition, the Association is required to carry various forms of insurance. These expenses are paid through the collection of a regular assessment charged to each homeowner in the association. These regular assessments are collected annually by the HOA.

Annual Meeting
This is the yearly meeting of the members at which a summary of the year's activities is given and annual reports are distributed. Notices will be sent prior to the meeting to notify you of the time and location of the meeting. This meeting is usually scheduled just after the first of each year.

The meeting was called to order by President Dan Ottinger at 7:00 PM.
The Roll call of Officers was made, and the following were present:

Steve Peterson, Vice President
Richard Westdyk, Treasurer
Tim Howe, Secretary
 
Peter Baltmanis, Asst. Secretary, was absent.
 
There was one home-owner family in attendance.
 
Secretary’s Report:
 
The minutes of the February 16, 2010 annual meeting, plus the July 27, 2010 Board Meeting were reviewed and accepted.
 
Treasurer’s Report:
 
Richard presented the annual report for 2010 versus budget, plus the 2011 budget. Expenditures were all in line, with overall expenditures lower in 2010 than they were in 2009 when we made major improvements to the entry area. We continue in accrue funds to replace the fencing that the HOA is required to maintain, so that dues can remain somewhat flat over the long term.
 
Richard is looking at dues increasing at about $5.00 per year over the next several years.
 
The Treasurer’s Report was accepted as submitted.
 
Committee Reports: 
 
The activities committee reported that we will have a Spring Festival in April. The Newsletter and website will provide more details, and solicite volunteers, as that gets closer.
 
There will be no HOA sponsored garage sales this year due to lack of interest and support.
 
Old Business:
 
CC&R Enforcement: The Board is still attempting to resolve a few CC&R violations. To date no one has been fined, but without owner cooperation, that could happen in 2011. The Board stresses that we are not here to be the police, but on the other hand, the CC&R regulations are in place to keep EVERYONE’S property values higher. We appreciate your cooperation.
 
Trees along Garden Road: On the public side of the fence along Garden there are 9 Sweet Gum trees that had grown to the height they approached the power lines, and Oncor trimmed them without thought to the final appearance. We discussed trying to save them, or just having them removed.
 
The Waters family has three of these trees directly behind their house, and enjoy the limited shade that the trees provide. They will have their arborist look at the trees, and provide us with a recommendation to either (1) save the trees by shaping them into a healthy contour, or (2) recommend removal, with an estimate for that. Once we have recommendations and pricing, we will talk with the other affected homeowners, and then make a decision.
 
The Waters offered to pay any costs of having the trees behind their house saved. These three are the least noticeable of the nine, as they are north of the turn on Garden.
 
New Business:
 
Election of Officers for 2011: Steve Peterson has served for a number of years, as is not willing to serve again for another year. He will be replaced by Phillip Tinsley. The other Board Members are willing to serve another year at this point, and as there were no other volunteers or nominees, the balance of the Board will remain the same.
 
Service on the Board is voluntary, and takes just a little bit of time over the course of the year. Without volunteers, management of the HOA will be turned over to a professional management company, which would double or triple your annual dues. A professional management company would not operate with the neighborly flexibility that the local Board operates with. So please consider how you can help in the future.
 
Audit Committee: We currently do not have our books audited, and while Rick has done an excellent job for the past several years, we feel it is our obligation to have an audit committee in place that reviews our finances annually. We can either do this with volunteers, or hire an outside firm. With the growing reserve fund, we need a simple annual audit to verify that our funds are, in fact, there. 
 
Are there any accountants/CPA home owners willing to volunteer two hours a year?
